Further building common understandings on international law and cyberspace: Launch of Thailand’s national position

For over a decade, States have affirmed that international law, in particular the United Nations Charter, is applicable to the conduct of States in cyberspace and is essential for maintaining an open, secure and stable information and communications technology environment. During the substantive sessions of the current Open-ended Working Group (OEWG) cycle, an increasing number of States have affirmed that some international rules and principles, in addition to those enshrined in the UN Charter, are also applicable to cyber activities, such as customary international law on State responsibility, international human rights law and international humanitarian law.

Building on this momentum, Member States in previous OEWG annual progress reports called for the sharing of national views on how international law applies in cyberspace. Thailand decided to answer this call by launching its own national position. In doing so, Thailand joins a further 31 States and two regional groups (African Union and European Union) that have already published their positions. UNIDIR’s Security and Technology Programme is pleased to have had the opportunity to support the Government of Thailand in this endeavour.

This event will present Thailand’s national position, offer reflections on States’ experiences in formulating their national and regional positions, and highlight the meaningful contributions they represent in fostering common understandings of how international law applies in cyberspace. With the current OEWG’s mandate coming to an end, this event will also offer thoughts and reflections on the progress achieved and the growing momentum towards building additional understandings of international law’s application in the cyber domain.
